These Terms govern your use of the XSCACE Simple Configurator and Floorplan Sound Simulation tools and related services (the "Service"), operated by XSCACE Inc. ("XSCACE", "we", "us"), a company incorporated in Ontario, Canada. By using the Service you agree to these Terms.
The Service helps audio integrators design, simulate and document sound systems. Simulation results, SPL predictions, room-mode figures and bills of quantities are engineering estimates provided for planning and must be verified on site during commissioning. XSCACE is not liable for decisions made solely on predicted values.
Some features require an account. You are responsible for the accuracy of your details and for activity under your account. You must be authorised to act for any business you represent.
You agree not to misuse the Service, including: reselling or redistributing it; uploading unlawful, infringing or malicious content; attempting to breach security or access other users' data; or overloading the Service. Third-party equipment you publish must be accurate and lawful; we may hide or remove content that is reported or violates these Terms.
You retain ownership of the projects, floor plans and product data you upload. You grant XSCACE a licence to store and process them to operate the Service. Product data you publish to the shared catalogue may be shown to other users, attributed to your company.
The Service, XSCACE branding and the curated product catalogue are owned by XSCACE and its licensors. No rights are granted except as needed to use the Service.
Payments are processed by Razorpay. By subscribing you authorise recurring charges to your chosen payment method. Prices may change with notice for future billing periods.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, XSCACE's total liability arising from the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses.
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive termination will do so.
We may update these Terms; material changes will be notified. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and disputes are subject to the courts of Ontario.
